Allgemeine Geschäftsbedingungen (AGB)

Terms & Conditions

1. Scope

These Terms & Conditions (the "Terms") govern all orders placed by consumers ("you", "the customer") through this online shop (the "Shop") for pet products and related goods. They apply in the version in force at the time an order is placed. The Shop is operated as a business-to-consumer (B2C) store and addresses customers worldwide; prices and orders are processed in Euro (EUR). By placing an order you confirm that you have read and accepted these Terms.

2. Seller / Contract Partner

Your contract partner is the following sole trader based in Germany:

  • Owner: Julian Peter BuPeSü
  • Full postal address: stated in our Legal Notice.
  • Email: bupesuesoehne@gmail.com
  • Phone: +49 1578 8331594

The seller is an individual sole trader who sells internationally and conducts business in English. All references to "we", "us" or "the seller" in these Terms refer to the person and contact details listed above.

3. Contract Formation

The presentation of products in the Shop does not constitute a legally binding offer, but rather an invitation to you to submit an offer. By clicking the order button at the end of the checkout process, you submit a binding offer to purchase the goods in your shopping cart.

After you place your order, we will send you an automatic confirmation of receipt by email. This confirmation of receipt does not yet constitute acceptance of your offer. A binding contract is formed only when we expressly accept your order in a separate email (order or shipping confirmation) or when we dispatch the goods to you. We reserve the right to decline an order, for example if a product is unavailable.

The text of the contract is not stored by us in a way that is separately accessible to you after the conclusion of the contract. Please save the order data yourself.

4. Prices and Small-Business Note

All prices are quoted in Euro (EUR) and are total prices. They do not include any shipping costs, which are stated separately during the checkout process before you submit your order.

Small-business scheme: The seller applies the small-business scheme (Kleinunternehmerregelung) pursuant to Section 19 of the German Value Added Tax Act (§ 19 UStG). For this reason, German value added tax (VAT) is not shown or charged on the prices, and the seller does not have a VAT identification number.

Please note that for deliveries to destinations outside the European Union, additional customs duties, import taxes or other charges may be levied by the authorities of the destination country. Any such charges are borne by you and are not included in our prices or shipping costs.

5. Payment

The payment methods available to you are displayed in the Shop and during the checkout process. We reserve the right not to offer certain payment methods for a particular order and to refer you to other payment methods.

Unless otherwise agreed, payment is due immediately upon conclusion of the contract. If you select a payment method that involves advance payment, the goods are reserved for you and are shipped after we have received the full amount due.

6. Delivery and Shipping

We deliver internationally. Shipping costs and delivery options are shown to you during the checkout process before you place your order.

We operate an honest dropshipping model. This means that some items are shipped directly from our partners or from abroad. As a result:

  • The typical delivery time is 5 to 10 business days after conclusion of the contract (or, in the case of advance payment, after receipt of payment), unless a different period is stated for the individual product.
  • If your order contains several items, these may be sent in separate part-shipments and may arrive at different times. Where part-shipments occur, you will not incur any additional shipping costs as a result.
  • Delivery times are estimates and may vary due to customs processing, carrier handling or other circumstances outside our reasonable control.

If a product you have ordered is not available, or cannot be delivered within a reasonable time, we will inform you without undue delay. In such cases, any payment already made for the unavailable item will be refunded promptly.

The risk of accidental loss or deterioration of the goods passes to you as a consumer upon handover of the goods to you, or to a recipient designated by you.

7. Retention of Title

The goods remain our property until the purchase price has been paid in full. You may not pledge the goods or transfer them by way of security before ownership has passed to you.

8. Statutory Warranty

The statutory rights regarding defects (warranty) apply. As a consumer, you are entitled to the statutory warranty rights for defective goods under the applicable mandatory law. Nothing in these Terms limits or excludes the warranty rights to which you are entitled by law.

If the goods are defective, please contact us using the contact details set out in Section 2 so that we can arrange the further handling of your claim, including any return, repair or replacement.

9. Liability

We are liable without limitation for damages arising from injury to life, body or health, for damages caused intentionally or by gross negligence, and to the extent that we have assumed a guarantee or are liable under mandatory statutory provisions, such as product liability law.

In the event of a slightly negligent breach of an essential contractual obligation (an obligation the fulfilment of which is necessary for the proper performance of the contract and on the observance of which you may regularly rely), our liability is limited in amount to the foreseeable damage typical for this type of contract.

Any liability beyond the foregoing is excluded. The above limitations of liability also apply in favour of our legal representatives and vicarious agents. Mandatory statutory rights remain unaffected.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can access at the official European Commission ODR website. Our email address for any communication is set out in Section 2 above.

We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board. We would, however, encourage you to contact us directly first so that we can work together to resolve any issue.

11. Final Provisions

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. As a consumer, you additionally benefit from any mandatory consumer protection provisions of the country in which you have your habitual residence that cannot be derogated from by agreement.

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
